BOOTMARK ("we," "our," or "us") operates the BOOTMARK service management platform accessible at bootmarkapp.com and related mobile applications. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our services.

By accessing or using BOOTMARK, you agree to this Privacy Policy. If you disagree with any part, please discontinue use of our services.

1. Information We Collect

Account & Registration Data

When you create a BOOTMARK account, we collect: name, email address, phone number, business name, business address, and billing information (processed securely via our payment processors).

Business Operations Data

As you use BOOTMARK, we store data you create or upload: work orders, job photos, client records, employee information, invoices, estimates, contracts, scheduling data, and form submissions. This data belongs to you and is stored on your behalf.

Location Data

With your permission, we collect GPS location data from crew members' mobile devices during active work sessions. This data is used for crew tracking features and is accessible only to authorized users in your account. Location collection stops when crew members are not actively checked in to a job.

Usage & Technical Data

We automatically collect: IP address, browser type and version, device identifiers, pages visited, time on page, referring URL, and error logs. This helps us improve platform performance and diagnose issues.

Communications

When you contact us via email, phone, or chat, we retain records of that communication to provide support and improve our services.

2. How We Use Your Information

  • To provide, operate, and maintain the BOOTMARK platform
  • To process payments and send billing communications
  • To send service-related notifications (job assignments, invoice reminders, contract alerts)
  • To provide customer support and respond to inquiries
  • To send product updates, new feature announcements, and marketing emails (you may opt out at any time)
  • To detect, prevent, and address technical issues and fraudulent activity
  • To analyze aggregate usage trends and improve our product
  • To comply with legal obligations

3. How We Share Your Information

We do not sell your personal data. We share information only in these circumstances:

Service Providers

We use trusted third-party services to operate BOOTMARK: Firebase/Google Cloud (database and authentication), Stripe/Authorize.net (payment processing), SendGrid/Gmail SMTP (email delivery), and cloud hosting providers. These vendors process data only as directed by us and are contractually bound to keep your data confidential.

Legal Requirements

We may disclose information if required by law, court order, or governmental authority, or if we believe disclosure is necessary to protect our rights, prevent fraud, or protect user safety.

Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity, who will be bound by this Privacy Policy.

4. Data Retention

We retain your account data for as long as your account is active. If you cancel your subscription, we retain your data for 90 days to allow account restoration. After 90 days, data is permanently deleted from our systems. You may request immediate deletion by contacting us at helpdesk@bootmarkapp.com.

5. Data Security

We implement industry-standard security measures: SSL/TLS encryption for all data in transit, encrypted storage for sensitive data at rest, two-factor authentication (2FA/MFA) for account access, role-based access controls, and regular security audits. No transmission method is 100% secure — we cannot guarantee absolute security but commit to using reasonable safeguards.

6. Your Rights (California & US State Privacy Laws)

Depending on your state of residence, you may have the following rights under laws including CCPA (California), VCDPA (Virginia), CPA (Colorado), and others:

  • Right to request deletion of your personal data

8. Children's Privacy

BOOTMARK is a business software platform not directed at children under 13. We do not knowingly collect personal data from children. If you believe a child has provided us data, contact us immediately and we will delete it.

BOOTMARK is primarily operated from the United States. If you access our services from outside the US, your data may be transferred to and processed in the US, where data protection laws may differ from your jurisdiction. By using BOOTMARK, you consent to this transfer.

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date and notify active subscribers via email. Your continued use of BOOTMARK after changes constitute acceptance of the updated policy.
